FORESTBURGH –– The Forestburgh Town Board passed Local Law #1 of 2022 during their regular meeting on Thursday, which will enact a three-month land use moratorium that directly affects that of the Lost Lake Holdings LLC Development.
During the public hearing on the law, set just prior to the regular meeting, members of the community and prospective workers and residents of the delayed development made their opinions known.
Attorney Steven Barshov of Sive, Paget, & Riesel P.C., who represents owner and developer of Lost Lake Holdings LLC (LLH), Rabbi Mordechai Halberstam, was one of many who spoke before the Board Thursday night.
Barshov claimed the town’s laws regarding escrow accounts were illegal, to which he wrote in his letter to Town Supervisor Dan Hogue Jr. and Code Enforcement Officer Glenn Gabbard, dated November 12, “the Town has no legal authority to charge against or disburse from the Lost Lake Escrow for any services.”
Justin Gray, who was employed by Lost Lake Holdings LLC roughly seven months ago, spoke before the Board in opposition to the moratorium.
“They [Gray’s family] see the benefit of me working here. They see me getting my paycheck on time, they see everything being taken care of.”
Another individual who vocally opposed the moratorium was Yehuda Miller, vice-president of Lost Lake Holdings LLC.
“You [Supervisor Hogue] told me that in Forestburgh, the mentality is ‘live and let live,’” said Miller.
“Some people may be aware there are some very ugly, disgusting comments posted online about Orthodox Jews coming to Forestburgh.”
"I wonder, does ‘live and let live’ include people like me,” added Miller.
In light of the ‘hate, bias, and bigotry’ that was alleged against the board as a possible cause of the moratorium, Councilman Steve Budofsky said,“I find it very disturbing, very insulting, and very hurtful.”
“I know for a fact that that is absolutely not the case in any part of this procedure,” he continued.
“Every bit of goodwill that you bring to our town, and hopefully will be your town, is returned by this board.”
Moratorium passed
Despite some backlash, the Board voted to enact the three-month moratorium.
“The board had to enact the moratorium to allow time to update our code pertaining to escrows,” Hogue told the Democrat.
“We need to update them to clearly define parameters such as maximum amounts that can be collected and clearly define their uses and give developers an avenue to dispute any charges against them.”
According to Hogue, the board will soon prepare a document regarding Town Codes that should be ready for public discussion in a month’s time.
“As soon as we have that ready we will promptly schedule a meeting to have another public hearing on the new escrow law and rescind the moratorium,” Hogue said.
“Our desire is to have a document that protects all parties involved.”
