Overview

The Zoning Board of Appeals meetings will be held in person at the Somerset Public Library, Cucinnotta Community Room, 1464 County Street, Somerset, MA - until further notice and unless otherwise noted.

The Zoning Board of Appeals meets once a month, typically on the 4th Thursday of the month. Petitions for variances, special permits, planned developments, sign permits, etc. are filed in the Town Clerk's Office. Petition applications, the Zoning Bylaw, and other required forms are available during regular office hours or click on the links on the left.

The Building Inspector is the Zoning Enforcement Officer. All Zoning inquiries should first be directed to the Building Inspector, at 508-646-2800 EXT 304. Once a determination is made that Zoning action is required, all necessary forms must be submitted to the Office of the Town Clerk. Zoning meetings generally are held on the 4th Thursday of every month. Petitions must be submitted no later than Noon on the last Thursday of the monthto be placed on the agenda for the following month.

Please note: if a business is located at a residential address, you must receive "in-home occupation" approval from the zoning board prior to a business certificate being issued. This includes home office and internet / online-based businesses.

Filing Deadlines

File by the last Thursday of each month at noon.

For the meeting  on the last Thursday of the follow ing month.

Please contact the town clerk's office to verify deadlines from time-to-time deadlines may change due to holidays.

It is the petitioner's responsibility to obtain an abutters list from the assessor's office and submit it with your application.

Please note: due to time constraints, any petitions received in excess of 7 for any given hearing date, may be scheduled on the following month's agenda/hearing, at the board's discretion.

Current Zoning Filing Fees

  • Residential: $200
  • Commercial: $400
  • In-home occupation: $75
  • Appeals: $75
  • Six-month extension: $250
  • Request to continue by petitioner: residential $100 by commercial $200
  • Late fee: $100 this applies for filings where work has started without a building permit, in addition to the regular filing fee

Procedural Changes Effective March 1, 2021

All applicants will now be responsible for preparing the Abutter's notices for mailing themselves and will also be responsible for paying their portion of the Legal Ad fee which covers the ad for their petition, prior to their scheduled hearing. Further instructions will be provided.

These rules will not apply to petitioners filing appeals
